One argument presented by the local tribal groups was that the Alberta Gaming & Liquor Commission (AGLC) did not possess the necessary legal authority to manage PlayAlberta. They contended that the AGLC's jurisdiction pertains primarily to the regulation of gaming, cannabis, and alcohol, and that it should not be involved in the iGaming industry.

Some gaming regulatory bodies across Canada also serve dual roles as gaming operators. The local tribes claimed this arrangement violates Canadian federal statutes, particularly relevant to the situation in Alberta. Critics also contend that this structure poses significant potential for conflicts of interest.

In their legal argument, they asserted that the AGLC must either operate without a valid casino license or is effectively issuing a gambling license to its own operation, thereby contradicting its own regulatory framework.

Outcome of the Tribal Lawsuit

As reported by the Calgary Herald, the initial court dismissed the case back in February, and an appellate court recently reaffirmed that ruling.

While it is acknowledged that Canada’s Criminal Code prohibits games of chance and lotteries , the panel recognized that provincial governments might be granted exceptions for managing authorized lottery initiatives.

The judges noted that while other entities would need provincial licensing and approval to run an authorized lottery, provincial authorities might not be held to the same requirement.

In a related setback, tribal casinos were temporarily closed during the lawsuit, as a measure to mitigate the pandemic, which left PlayAlberta as the sole casino operator within the province.
